Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you and Lumon LLC (“Lumon LLC,” “we,” “us,” or “our”), the company that operates ChompIt (the “Service”), including the ChompIt mobile app, the chompit.app website, and related features.

By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

ChompIt is a shopping list with a memory. You can:

• keep a personal shopping list, stored on your device;
• create or join a household and share a list with its members, including household shopping trips that let members add what they need while you shop;
• add your list to your home screen as a widget;
• optionally connect your own store accounts, or scan receipts, so ChompIt remembers what you buy and what you paid.

ChompIt is free to use. It does not sell products or process payments.

You must be at least 18 years old and a resident of the United States to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide is accurate.

You are responsible for the activity that occurs under your account and for keeping your sign-in methods and device secure. Notify us promptly at support@chompit.app if you suspect unauthorized use of your account. We may suspend or close accounts that violate these Terms or that we reasonably believe present a risk of abuse or harm.

ChompIt lets you connect a retailer account that you hold, such as Target, Walmart, Kroger, or Amazon (each, a “Connected Account”).

• You sign in on the retailer’s own website. The sign-in page belongs to the retailer and opens inside the app. ChompIt does not ask for, see, or store your retailer password or one-time codes.
• Your account, at your direction. By connecting a Connected Account, you confirm that it is your own account (or one you are authorized to use), and you direct and authorize ChompIt, as your limited agent, to read the order and purchase history that you can see in that account and save it to your ChompIt account. This is read-only: ChompIt does not place, change, or cancel orders, make purchases, or change your retailer account.
• Staying connected. To keep you signed in, the retailer’s sign-in cookies are stored on your device for up to 30 days, and ChompIt checks for new purchases about once a day while you use the app, as described in our Privacy Policy.
• Third-party terms. Your Connected Account is governed by your agreement with the retailer. You are responsible for your own compliance with the retailer’s terms. ChompIt is not affiliated with, endorsed by, or sponsored by any retailer, and retailer names and logos are used only to identify the account you choose to connect. If a retailer objects, or if you ask us to stop, we will stop accessing that Connected Account.
• No guarantee of retailer data. Retailers control their websites and may change or block them at any time. We do not guarantee that any store can be connected, that every purchase will be found, or that the item names, prices, or other details a retailer shows are complete or accurate.
• Disconnect anytime. You can disconnect a Connected Account at any time in Connections, which removes the saved sign-in from your device and ends our access going forward. You can also delete the purchases imported from it.

You keep ownership of the lists, notes, photos, and other content you add to ChompIt (“Your Content”). You give us a limited license to store, process, and display Your Content only as needed to provide the Service to you and, for household lists, to the members of your household. When you scan a receipt, you authorize us to send the photo to our text-reading providers to read it, as described in our Privacy Policy. Text read from photos is automated and may contain mistakes.

Anything you add to a household list, and the store label shown during a trip you start, is visible to the members of that household. Only invite people you know. You can leave a household or decline an invitation at any time.

You agree not to:

• use the Service for any unlawful, fraudulent, or deceptive purpose;
• connect an account you do not own or are not authorized to use, or submit receipts or content that you know to be altered or fabricated;
• harass, threaten, or abuse other users, including through household lists or invitations;
• interfere with, disrupt, overload, reverse-engineer, or attempt to gain unauthorized access to the Service or its systems, or use automated means to access the Service except as we permit;
• misrepresent your identity or impersonate others; or
• use the Service in a way that violates the rights of other users or any third party.

We may add, change, suspend, or remove features of the Service, including which stores can be connected, at any time. We will try to give reasonable notice of material changes where practical.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that any store connection will be available, or that purchase history, prices, or other information shown in the Service will be complete or accurate.

To the maximum extent permitted by law, Lumon LLC and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amounts you paid us in the twelve months before the claim or (b) US $100.

You may stop using the Service at any time and can delete your account in the app under Profile → Privacy & data or as described at chompit.app/delete-account. We may suspend or terminate your access, with or without notice, if you violate these Terms, if required by law, or to protect the Service or its users. Upon termination, your right to use the Service ends, though Sections 10 through 14 survive.

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means and update the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State in which Lumon LLC is organized (the State of Delaware), without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the state and federal courts located in that State, to the extent permitted by applicable law.
